Brazil is taking a major step to strengthen oversight of its growing crypto industry. The Central Bank of Brazil paves the way for more strict scrutiny of digital assets with approval of stricter rules for virtual asset service providers.

New Rules Will Begin in 2027

The new rules will take effect January 1, 2027, and will apply to virtual asset service providers, also known as SPSAVs. These companies provide services like crypto trading, custodial services, funds transfer of digital assets among others.

Higher Standards for Crypto Firms

The new regulations require crypto companies in Brazil to adopt stricter financial and operational risk standards. This involves maintaining minimum capital reserves, strengthening risk management frameworks and submitting regular information to regulators on capital and operations.

The central bank stated these moves aim to enhance the market’s stability and shield bank customers from the risks they may face. Regulators are hoping that digital asset providers will be subject to the same regulations as traditional financial institutions, as the crypto sector continues to expand.

Crypto Firms to Face Broker-Like Oversight

A key part of the new framework is classifying SPSAVs as Type 3 institutions. This means they are regulated similarly to securities brokers and distributors. The reasoning behind the ruling is a basic regulatory rule: companies with similar risks should be subject to similar regulation.

Gradual Transition Until 2028

The transition will be done in phases. By June 30, 2028, all SPSAVs will move into Segment 4, or S4, under Brazil’s banking regulatory system. This allows companies to adapt to stricter compliance standards.

Meanwhile, smaller banks in Segment 5 will no longer be able to provide crypto-related services. Businesses say regulators are worried these companies may lack controls to manage risk associated with digital assets.

What This Means for Brazil’s Crypto Market

With this decision, Brazil is entering a new era of crypto regulations. Although the rules will raise compliance costs for firms, they may make for a better build-up of trust and for longer-term stability in the market.
